obligation to contest adoption

August 20, 2012

Indiana’s law seemingly requires a natural parent to contest an adoption by filing documentation with the Court where the adoption petition is pending.  Indiana Code 31-19-10-1 provides, in part, as follows:

"A person contesting an adoption must file a motion to contest the adoption with the court not later than thirty (30) days after service of notice of the pending adoption."

In other words, if stepdad seeks to adopt Jr., then Dad has to file an objection with the Court within 30 days of being placed on notice of the stepdad’s attempt to adopt Jr.
